Appurtenance rights are additional interests or rights associated with a specific piece of land. Examples include:
- air rights
- water rights
- oil and gas rights
- solid mineral rights
- support rights
Appurtenances may or may not be transferred with the land as part of a sales transaction. If appurtenance rights are important to you, it will be important for your real estate agent to verify the rights available. Landowner’s can sell appurtenant rights separately from the land, such as keeping ownership in the land and building on top of the land, but selling the mineral rights to a mining company.
